Welcome to The Babe Bus. These Terms & Conditions ("Terms") govern your use of thebabebus.net (the "Site") and your booking and receipt of services from The Babe Bus ("The Babe Bus," "we," "our," or "us"). Our Cancellation Policy and Mobile Service Agreement & Liability Waiver are part of these Terms and are incorporated by reference.

By accessing the Site or booking services, you agree to these Terms. If you do not agree, please do not use the Site or book with us.

1. Eligibility

You must be at least 18 years old to book services or create an account. Clients under 18 may receive certain services only with a parent or legal guardian who books the appointment, signs the Service Agreement on the minor's behalf, and is present during the service. Tooth gem services are available to clients 18 and older only. We reserve the right to request proof of age.

2. Our Services

The Babe Bus provides mobile esthetic and beauty services performed by licensed professionals from our mobile spa van, including, but not limited to:

Facials and hydradermabrasion facials
Waxing
Brow services
Lash services
Tooth gems
Other beauty and skincare services we may offer from time to time

Our services are cosmetic, not medical. We do not diagnose, treat, or cure any medical or dental condition, and nothing we say or provide is medical or dental advice. Consult a physician, dermatologist, or dentist for any health concern.

Services, pricing, and availability may change at any time without notice. Some services require a consultation before treatment, and we may decline or modify a service based on that consultation.

3. Service Area and Mobile Service

We serve the Denver metropolitan area. Appointments outside our standard service area may be subject to a travel fee disclosed at booking, or may be declined. Because we come to you, service depends on safe, legal, and accessible parking at your location; see Section 6 and our Cancellation Policy.

4. Booking

You agree to provide accurate, complete, and current information when booking and to update it if it changes. Before your first appointment (and periodically afterward), you must complete our intake form and sign our Mobile Service Agreement & Liability Waiver. We may cancel or reschedule any appointment where required forms are incomplete, and cancellation fees may apply.

Bookings are subject to confirmation. A booking request is not confirmed until you receive a confirmation from us or our booking platform.

5. Pricing, Payment, and Card on File

Prices are those shown at the time of booking, exclusive of applicable taxes and gratuity. Gratuity is appreciated but never required.
Payment is due in full at the time of service unless otherwise stated at booking. We accept major credit and debit cards and approved electronic payment methods through our payment provider. We may require a deposit to hold certain appointments; deposits are applied to the service price and are subject to our Cancellation Policy.
By booking, you authorize The Babe Bus to keep a payment method on file through our secure payment provider and to charge that payment method for services rendered and for any late-cancellation, no-show, or access-related fees described in our Cancellation Policy.
Disputed or declined charges do not release you from amounts owed. You are responsible for reasonable costs of collection where permitted by law.

6. Service Location, Parking, and Access

Because our spa is a vehicle, you are responsible for providing a service location that is:

Legal and permitted: you have the right to have a commercial vehicle park and operate at the location for the duration of the appointment (including any HOA, apartment, workplace, or landlord rules), and you are responsible for obtaining any required permission.
Safe and accessible: a level, stable, legally parkable space suitable for a van of approximately 21.9 feet long and 9.2 feet tall, reasonably close to the entrance, free of hazards, and accessible in current weather and road conditions.
Ready at the scheduled time.

If we determine, in our reasonable judgment, that the location is unsafe, inaccessible, or not permitted, we may relocate the service nearby, reschedule, or cancel, and the fees in our Cancellation Policy may apply. We are not responsible for parking tickets, towing, or property damage resulting from a location you selected in violation of this Section.

We may reschedule or cancel an appointment without charge to you because of severe weather, unsafe road conditions, vehicle or equipment issues, provider illness, or other circumstances beyond our reasonable control. In that case, any deposit will be applied to a rescheduled appointment or refunded at your choice.

7. Gift Cards, Packages, and Promotions

Gift cards are redeemable for services only, are not redeemable for cash except as required by Colorado law, and do not expire. Prepaid packages and promotional offers are subject to the specific terms disclosed at purchase. Promotions cannot be combined unless stated and have no cash value.

8. Your Responsibilities and Health Disclosure

For your safety, you agree to:

Disclose accurately and completely all relevant health information requested on our intake form, and update us before each appointment if anything changes (including new medications, pregnancy, recent sun exposure, or recent cosmetic or medical procedures).
Follow all pre-care and aftercare instructions we provide.
Tell your provider immediately if you experience discomfort during a service.
Not receive a service that your provider has advised is contraindicated for you.

We rely on the information you provide. You are responsible for any harm resulting from information you withhold or misstate.

9. Refusal of Service and Conduct

We reserve the right to refuse, stop, or modify any service, at our sole discretion, when:

Your health or safety, or our provider's, may be at risk
A service is contraindicated for you
Required consent or intake forms are not completed
You appear to be ill, intoxicated, or impaired
Inappropriate, abusive, threatening, or harassing behavior occurs, including sexual comments or advances of any kind
The service location does not meet Section 6

For the comfort and safety of everyone, only the client receiving services (and a parent or guardian of a minor client) may be inside the van during an appointment, and pets are not permitted inside. If a service is refused or stopped because of your conduct or failure to meet these Terms, the full service price or the applicable cancellation fee may be charged.

10. Results and No Guarantee

Skincare and beauty results vary from person to person and depend on skin type, condition, lifestyle, aftercare, and other factors outside our control. We make no guarantee about the results, duration, or outcome of any service. Temporary redness, sensitivity, irritation, or other reactions can occur with cosmetic services even when performed properly. Descriptions, photos, and reviews on the Site or social media are illustrative and do not promise a particular result.

11. Disclaimer of Warranties

The Site and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Nothing in this Section limits our obligation to perform services with the care of a reasonably skilled licensed professional.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY COLORADO LAW:

(a) THE BABE BUS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF ENJOYMENT, ARISING OUT OF OR RELATING TO THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

(b) OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR A SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM.

(c) THESE LIMITATIONS DO NOT APPLY TO LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

13. Indemnification

You agree to indemnify and hold harmless The Babe Bus and its owners, employees, contractors, and agents from any claims, damages, losses, and reasonable expenses (including attorney fees) arising out of (a) your breach of these Terms, (b) inaccurate or incomplete health or intake information you provided, (c) your failure to follow pre-care or aftercare instructions, or (d) any claim by a property owner, HOA, or other third party relating to the service location you selected.

14. Intellectual Property

The Site and all content on it — including text, photos, graphics, logos, the name "The Babe Bus," and our van design — are owned by or licensed to The Babe Bus and are protected by copyright, trademark, and other laws. You may view and share Site content for personal, non-commercial purposes only. You may not copy, modify, distribute, or use our name, logo, or content for any commercial purpose without our written permission.

We love being tagged. If you post content about The Babe Bus or submit a review, testimonial, or photo to us, you grant us a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business, including on the Site and social media, with attribution to your public handle unless you ask us not to. Photos taken by us of you or your treatment area are used only with your separate written consent in the Service Agreement.

16. Website Use

You agree not to use the Site to do anything unlawful, to interfere with the Site's operation, to scrape or copy content, to submit false booking information, or to attempt to access accounts or systems that are not yours. We may suspend or block access to the Site for any violation.

17. Communications

By providing your email address or phone number, you agree that we may contact you about your bookings and account. Marketing communications are sent only with your consent, and you may opt out at any time. Text messaging terms are in our Privacy Policy.

18. Dispute Resolution and Governing Law

Talk to us first. If you have a concern about a service, contact us at [email protected] within 48 hours of your appointment so we can make it right. Before starting any legal action, you agree to notify us in writing describing the issue and to give us 30 days to resolve it informally.

These Terms and any dispute arising out of the Site or our services are governed by the laws of the State of Colorado, without regard to conflict-of-law rules. Any legal action must be brought in the state or federal courts located in Denver County, Colorado, and you consent to their jurisdiction. Either party may instead bring a qualifying claim in small claims court. To the extent permitted by law, any claim must be filed within one year after it arises.

19. General Terms

Changes. We may update these Terms at any time by posting a revised version with a new Effective Date. Continued use of the Site or booking after posting means you accept the changes.
Entire agreement. These Terms, together with the Privacy Policy, Cancellation Policy, and Service Agreement, are the entire agreement between you and The Babe Bus regarding the Site and services.
Severability. If any provision is found unenforceable, the rest remains in effect and the provision will be enforced to the maximum extent permitted.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign them in connection with a sale or transfer of our business.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including weather, road closures, vehicle breakdown, illness, or public emergencies.
